• Adopting legislation that makes hate crime and hate speech specific offenses or that provides enhanced penalties for any crimes committed with a bias motive;
• Amendments on criminal code which will address hate crime and hate speech based on sexual orientation or gender identity;
• Adoption anti – discrimination law which criminalize any discrimination based on sexual orientation or gender identity;
Why is this important?
The Criminal Code of the Republic of Azerbaijan does not address hate crimes based on gender identity or sexual orientation. This issue should be addressed as it would help to protect the LGBTI community from hate attacks based on gender identity or sexual orientation. Given that there is no uniform definition of ‘hate crimes’, it is difficult to track hate crime cases at each stage of criminal proceedings. Importantly, the adoption of the uniform definition would also help policymakers and the wider public to better understand the response to such crimes from the prosecution organs.
